Action for personal injuries sustained as a guest in an automobile involved in a collision was commenced by Carol Ann Smith, respondent, against Rural Mutual Insurance Company (Rural Mutual), appellant, insurer of that automobile, owned by Ben Thiede. Rural Mutual denied coverage under the policy, and by a cross-complaint impleaded Donald C. Foss as defendant for contribution for negligently driving the other automobile. Trial was to a jury which found that, in effect, Carol Ann Smith was a guest in, and not the driver of, the Thiede car, that Donald C. Foss was not negligent, and that the driver of the Thiede car was 100 per cent causally negligent. The trial court denied Rural Mutuals motion for a new trial and entered judgment on the verdict. Rural Mutual now appeals from that judgment. Foss desires review of the order of the trial court denying his motion to dismiss the cross-complaint impleading him as defendant.
