The plaintiff, Carol Ewan, sues for injuries suffered when struck by the defendants northbound car as she walked eastward across U.S. Highway 91 at about 10th North in Salt Lake City. Trial was commenced before a jury. At the close of the first day, upon the basis of the plaintiffs evidence as to how the accident occurred, the court granted defendants motion to dismiss on the ground that it showed that she was contributorily negligent as a matter of law. Plaintiff appeals.
